Under the new Minnesota Omnibus Jobs Bills, noncompete agreements are outlawed in the state of Minnesota effective July 1, 2023.

Are there any new situations going forward after July 1 in which these agreements can still be executed?

Yes, but limited only to the sale or dissolution of the business.

What about existing noncompete agreements executed prior to July 1, 2023? Are they still valid?

Yes, but only if reasonable and limited in geographic scope.

Are existing confidentiality and non-solicitation agreements still valid? Can they be executed after July 1?
